I. For foreigners:

Foreigners entering, exiting, transiting, and residing in Vietnam need to comply with the following:

- Comply with Vietnam’s laws; respect cultural traditions, customs and practices of Vietnam;

- Activities in Vietnam must be consistent with the purpose of entry, programs declared in visa, temporary residence card application or stay extension application; Foreigners entering the country for investment should have documents proving their investment in Vietnam, according to provisions of the Investment Law; foreigners practicing law in Vietnam must have a practice license as prescribed by the Lawyer’s Law; foreigners coming to work must have a work permit as per Labour Code regulations; foreign students must have the documents of admission of schools or educational institutions in Vietnam;

- Foreigners are only permitted to reside in Vietnam within the duration of stay granted by competent authority. In case of stay extension, they must request the inviting, sponsoring agencies, organizations, individuals to carry out the procedures in accordance with the provisions of Law.

- When travelling, foreigners must carry passports or other valid international travel documents, and documents related to residence in Vietnam, and present when requested by competent authorities;

- Present passports or valid international travel documents and documents related to residence in Vietnam to the accommodation establishments for temporary residence registration as per regulations; If foreigners change temporary residence or reside outside the address listed on their permanent residence cards, or if there is any changes in the passport information, they need to register their temporary stay again;

- Foreigners violating legal regulations on entry and exit or other legal regulations in Vietnam will be subjected to administrative sanctions or criminal prosecution as stipulated.

           II. For agencies, organizations, and individuals in Vietnam

1. Inviting and sponsoring agencies, organizations and individuals are responsible for:

- Complete procedures to invite, sponsor foreigners to enter, exit, reside in accordance with the law on entry, exit, residence of foreigners in Vietnam.

          - Guide and explain to foreigners to comply with the law and respect the cultural traditions, customs and practices of Vietnam;

          - Take responsibilities to sponsor in accordance with the provisions of law and coordinate with Vietnamese authorities to resolve arising issues related to invited and sponsored foreigners;

          - Coordinate with competent authorities to control activities of foreigners in accordance with the purpose of entry during their temporary stay in Vietnam; coordinate with the accommodation establishment to register temporary residence for foreigners;

          - Carry out procedures with state management agencies on industries, occupations, and fields that require permission before inviting or sponsoring foreigners to enter Vietnam to work in those industries, occupations, and fields;

          - Notify in writing the immigration authority that foreigners have been issued documents still valid for entry, exit, or residence but no longer need sponsorship during their temporary stay in Vietnam and coordinate with competent authorities to request the foreigners to leave the country.

          2. Other relevant agencies, organizations and individuals are responsible for:

          - Agencies, organizations and individuals are allowed to employ foreign workers, organize tourism programs for foreigners or let foreigners reside temporarily only when they reside legally in Viet Nam.

          - Agencies, organizations, and individuals that detect violations of the Law on foreigners’ entry into, exit from, transit through, and residence in Vietnam must immediately notify the nearest police authority; in case of detecting signs of violation in the border area, immediately notify the nearest police authority or border guard station.

          3. Note:

          - Accommodation establishments are responsible for requiring foreigners to present their passports and documents valid for residence in Vietnam to make temporary residence registration before agreeing to the foreigner's temporary residence. Temporary residence registration for foreigners is made via electronic platforms or by filling in temporary residence declaration forms.

          - Violations of the law by agencies, organizations, and individuals related to foreigners’ entry into, exit from, and residence in Vietnam will be subjected to administrative sanctions or criminal prosecution in accordance with provisions of Vietnamese law./.
