PROCEDURES FOR ENTRY PRECLEARANCE OF FOREIGNERS AND VIETNAMESE RESIDING OVERSEAS INTO VIETNAM AT IMMIGRATION DEPARTMENT OF MINISTRY OF PUBLIC SECURITY

Order and procedures:

Step 1: To prepare a dossier in accordance with the law. 

Step 2: To submit the dossier:

1. Vietnamese agencies and organizations, Vietnamese citizens and foreigners residing lawfully in Vietnam submit dossiers at the offices of the Vietnam Immigration Department - Ministry of Public Security: 

          + 44-46 Tran Phu Street, Ba Dinh District, Hanoi.

          + 335-337 Nguyen Trai Street, District 1, Ho Chi Minh City.

* Working time: From Monday to Saturday morning (excluding New Year’s Days, public holidays and Sunday).

2. The officer receiving the dossier shall check the legality and contents of the dossier: 

+ If the dossier is appropriately completed, the officer shall receive the dossier and give the receipt notifying the date of receiving results. 

+ If the dossier is not appropriately completed, the officer shall request the applicant to supplement the dossier. 

Step 3: To receive the result:

a) The person who comes to receive the result shall present the receipt to the officer for examination. The officer hands over the result in writing to the recipient  (including in case the request is not approved) and asks him/her to sign for receipt.

 b) Working time: From Monday to Friday every week (excluding New Year Days, public holidays and Sunday).

 Application submission: To submit dossiers in person at Immigration Department, Ministry of Public Security.

Contents and number of dossiers:

+ Contents of a dossier:

a) For agencies and organizations: An official request for pre-clearance of foreigners’ entry (NA2).

b) For individuals (sponsoring for family members): a sponsoring application form for foreign family members to enter Vietnam (NA3).

 + Number of dossier: 01 (one) set.

Processing time: Within 05 working days from the date of receipt of valid dossiers for foreigners who receive visas at overseas Vietnamese representative agencies or within 03 working days if foreigners receive visas at border gates.     

Subjects of application: Organizations, individuals. 

Competent authorities: Immigration Department 

Results of administrative procedures: Official reply in writing for pre-clearance of foreigners’ entry (NB1).

Fee: Free. 

Name of application form:

+ A request for pre-clearance of foreigners’ entry into Vietnam (NA2).

+ A sponsoring application form for foreign family members to enter Vietnam.

Eligible requirements:

1. Before carrying out procedures for inviting a foreigner to enter Vietnam, organizations and agencies must submit dossiers to prove their legal status at the Immigration Department, Ministry of Public Security.

2. Foreigners, Vietnamese holding foreign passports are not approved to enter Vietnam if they fall into the cases of “suspension from entry” prescribed in Vietnamese laws.

Legal basis:

+ Law on foreigners’ entry into, exit from, transit through and residence  in Vietnam (Law No. 47/2014 QH13) dated June 16th, 2014;

+ Circular No. 04/2015 / TT-BCA of the Ministry of Public Security dated January 5th, 2015 regulating the required forms relating to foreigners’ entry into, exit from, transit through and residence  in Vietnam/.
